On March 15, 2017 (the “Petition Date”), Bostwick Laboratories, Inc. and Bostwick Laboratories Holdings, Inc. (collectively, the “Debtors”) each filed a voluntary petition for relief under Chapter 11 of the United States Bankruptcy Code (the “Bankruptcy Code”).  The cases (collectively, the “Bankruptcy Cases”) are jointly administered under Case No. 17-10570 before the Honorable Brendan Linehan Shannon in the United States Bankruptcy Court for the District of Delaware (the “Bankruptcy Court”).  The Debtors are continuing to operate their business and manage their property as debtors-in-possession pursuant to Bankruptcy Code sections 1107(a) and 1108.

As a result of the commencement of the Bankruptcy Cases, an automatic stay is now in effect pursuant to Bankruptcy Code section 362(a) that, among other things, prohibits (i) any act, including the commencement or continuation of judicial, administrative or other actions or proceedings, to collect a prepetition claim against the Debtors, (ii) any act to create or enforce any lien against any property of Debtors, (iii) any act to obtain possession or control of any property of Debtors, and (iv) any attempt to terminate any contract or lease with Debtors, in each case other than via the proper procedure in the Bankruptcy Cases.
