On December 28, 2020, on motion of the Securities and Exchange Commission (“SEC”), the United States District Court, Central District of California, Southern Division (the “Court”), entered an order appointing Jeffrey Brandlin as the receiver for Elevate Investments, LLC, and its affiliates and subsidiaries (“Elevate Investments”). The SEC also obtained an order freezing the assets of Elevate Investments, Justin King, and Shannon King. At the January 19, 2021, hearing on the SEC’s motion for a preliminary injunction, the Court approved the motion and appointed the Receiver as the permanent receiver. The Receiver is unable to return any funds invested with Elevate Investments at this time, although the goal of the receivership is to locate assets and to make a distribution to investors. On February 10, 2023, the Receiver mailed claim forms to all known investors and creditors. The deadline to return the completed claim forms to the Receiver is April 11, 2023. If you do not receive a form or need an additional form, please click Here. You can also obtain one by emailing kandrassy@swelawfirm.com. Claim forms must be received on or before April 11, 2023, in order to be eligible for a distribution from the Receivership Estate. If the Receiver has questions about information on a claim, someone from the Receiver’s office will reach out to the claimant to get more information and to attempt to resolve any discrepancy informally. Once this process is complete and litigation claims are complete, the Receiver will seek Court authority to make a distribution to investors.
