Committee Statement
On August 17, 2023, the Official Committee of Unsecured Creditors filed a statement (the “Statement”) describing the Committee’s concerns regarding the Debtors’ prepetition activities and conduct of the Debtors’ directors and officers [D.I. 357]. The Committee’s Statement has been included as Exhibit B of the Debtors' Second Amended Combined Plan and Disclosure Statement [D.I. 442] and can be found here. As outlined in the Statement, the Committee recommends to general unsecured creditors classified as Class 4 of the current Plan that they vote against the Plan. The deadline for unsecured creditors to vote on the plan is September 28, 2023 at 5:00 p.m. ET.
