What is Chapter 11?
Chapter 11 of the U.S. Bankruptcy Code is a legal mechanism for court supervised restructuring of a company's obligations. Chapter 11 provides a way for companies to address their financial issues in order to become a viable entity, while continuing day-to-day operations.

Why did Roadhouse Holding Inc., Logan’s Roadhouse, Inc. and their affiliates (collectively, “Logan’s) file for protection under Chapter 11 of the U.S. Bankruptcy Code?
Logan’s took this step only after very careful consideration and consultation with experienced financial and legal experts. Logan’s decided that this would be the most effective path for it to protect the value of its assets for the benefit of its creditors and other stakeholders.

What does the bankruptcy filing mean for Logan’s restaurants and operations?
Logan’s remains a strong and vibrant brand in the casual dining space with more than 200 stores nationally in 23 states. Logan’s will operate in a “business as usual” mode during the Chapter 11 process. The Bankruptcy Court has authorized Logan’s to continue all customer programs without any interruption and to continue all compensation and benefits currently provided to current employees. Logan’s filed for bankruptcy protection under Chapter 11 of the United States Bankruptcy Code to restructure its balance sheet and strengthen the company for the long term. To that end, Logan’s has obtained the support of its existing secured lenders and additional funding to finance its operations during and after the bankruptcy.

How long will the chapter 11 process take?
Logan’s has entered into a Restructuring Support Agreement, under which holders of over 80% of its secured debt have agreed to support a chapter 11 plan of reorganization for Logan’s. The parties to the Restructuring Support Agreement are moving promptly towards the confirmation of a plan for Logan’s. However, there is no way to predict with certainty how long the process will ultimately take.

Am I a creditor of the Debtors?
If you believe that you are owed money by Logan’s from a claim arising before August 8, 2016, then you may be a creditor for the purposes of these Chapter 11 cases. None of Logan’s, Logan’s advisors and representatives (including Donlin Recano & Company, Inc.), nor the staff of the Bankruptcy Court can determine if you are a creditor of the Debtors. You may wish to consult your own legal advisor to determine if you are a creditor and your rights in these Chapter 11 cases.
The Debtors have filed their Schedules of Assets and Liabilities with the Bankruptcy Court, which list those parties the Debtors have identified as creditors as of August 8, 2016 and the amount of their claim. Do I need to file a proof of claim?
If you are a creditor, you will need to timely file a proof of claim form in order to receive a distribution under the Plan on account of your prepetition claim. The Bankruptcy Court has established a general claims bar date (i.e., a deadline by which parties must file a proof of claim) of October 7, 2016 at 5:00 p.m. (prevailing Eastern Time), except that the claims bar date for governmental units is February 6, 2017 at 5:00 p.m. (prevailing Eastern Time). Proofs of claim must be filed by the applicable claims bar date or you will not be treated as a creditor under Logan’s chapter 11 plan. What is the purpose of the chapter 11 plan?
Typically, the chapter 11 plan is a document which describes in detail how a debtor corporation will emerge from a Chapter 11 bankruptcy. It will detail which parties will be receiving distributions from the debtors’ bankruptcy estates on account of their claims. The chapter 11 plan must be approved by a vote of eligible creditors and confirmed by the Bankruptcy Court.
