The Debtors' Plan and Committee Recommendation
On April 21, 2023 the Bankruptcy Court approved the Disclosure Statement for the Debtors’ Second Amended Joint Chapter 11 Plan (the “Disclosure Statement”) and GWG has begun soliciting votes for the Debtors’ Second Amended Joint Chapter 11 Plan (the “Plan”). The Bondholder Committee is a co-proponent of the Plan and was heavily involved in negotiating the terms of the Plan. Each of you should have received, or should soon receive (i) a ballot for voting on the Plan, (ii) detailed instructions for how to vote on the Plan and (iii) other information regarding the Plan, including the Bondholder Summary found here. The Bondholder Summary explains the structure of the Plan, what L Bondholders can expect in terms of the timing and amount of recovery, and certain risks related to those recoveries. As is reflected in the Bondholder Summary, the Bondholder Committee supports the Plan because the Bondholder Committee believes that the Plan represents the best option for maximizing recoveries for L Bondholders, and encourages all L Bondholders to vote TO ACCEPT the Plan.
The deadline for submitting your Ballot to vote on the Plan is May 31, 2023 at 4:00 pm CT. Ballots should be submitted in accordance with the instructions provided with the Ballot.
